These Terms of Service ("Terms") govern your use of flywheeliq.io (the "Site"), operated by Words That Click, LLC ("we," "us," or "FlywheelIQ"). FlywheelIQ is a registered dba of Words That Click, LLC, a Missouri limited liability company.

These Terms apply only to your use of the marketing website. They do not govern the FlywheelIQ services themselves. If you become a FlywheelIQ client, your use of our services is governed by your separate client services agreement.

By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

Using the Site

You may use the Site to learn about FlywheelIQ, request a demo, and contact us. You agree to use the Site only for lawful purposes and in a way that doesn't:

  • Disrupt or interfere with the Site or anyone else's use of it
  • Attempt to gain unauthorized access to any part of the Site or its underlying systems
  • Submit false, misleading, or deceptive information through any form on the Site
  • Scrape, crawl, or use automated tools on the Site without our permission
  • Reproduce, copy, or repurpose Site content for commercial use without our permission

Demo requests and form submissions

When you submit a demo request or any other form on the Site, you confirm that the information you provide is accurate and that you have the right to provide it. We use the information you submit to follow up about FlywheelIQ, as described in our Privacy Policy.

Submitting a form does not create any obligation on our part to provide services to you, and submitting a form does not entitle you to any specific response or service.

Intellectual property

All content on the Site — including text, graphics, logos, images, code, and the FlywheelIQ name, branding, and design — is owned by Words That Click, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view and share Site content for personal, non-commercial purposes. You may not reproduce, modify, distribute, or create derivative works from Site content without our written permission.

The FlywheelIQ name, logo, and related marks are trademarks of Words That Click, LLC.

Third-party links

The Site may link to third-party websites and services. We don't control those sites and aren't responsible for their content, practices, or policies. Visiting third-party sites is at your own risk.

Disclaimers

The Site is provided "as is" and "as available." We make no warranties, express or implied, about the Site, including any warranty of merchantability, fitness for a particular purpose, accuracy, or availability.

We don't guarantee that the Site will be uninterrupted, error-free, or secure. We don't guarantee that any information on the Site is accurate, complete, or current. The Site, including all content on it, is for general informational purposes only and should not be relied on as professional, legal, financial, or business advice.

Limitation of liability

To the fullest extent permitted by law, Words That Click, LLC and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site — including lost profits, lost data, or business interruption — even if we've been advised of the possibility of such damages.

Our total liability for any claim related to your use of the Site is limited to one hundred dollars ($100) USD.

Some jurisdictions don't allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Words That Click, LLC and its officers, employees, and contractors from any claim, damage, loss, or expense (including reasonable attorney's fees) arising out of:

  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any third-party right, including intellectual property or privacy rights

Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top. If we make material changes, we'll make a reasonable effort to notify you — for example, by posting a notice on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.

Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice — including if we believe you've violated these Terms.

Governing law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Missouri, and you consent to the personal jurisdiction of those courts.

Severability

If any provision of these Terms is found to be unenforceable, the rest of the Terms will remain in full effect.

Entire agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and Words That Click, LLC regarding your use of the Site, and they supersede any prior agreements on this subject.
